These Terms of Use apply to the use of the browser game "Way of Citizen" at wayofcitizen.de. The provider is:
Kevin Heymann
Armstrongstraße 17A
63654 Büdingen, Germany
Email: spiel@wayofcitizen.de
Way of Citizen is developed and operated as a hobby/side project, see Legal Notice.
Basic use of Way of Citizen (city building, economy, alliances, attacks/defense, research) is free of charge. A contract for free use is formed by creating an account (registration, Google sign-in, or guest account). In addition, optional paid premium features can be purchased (see item 6).
An account can be created via email/password, via Google sign-in, or as a guest account (no registration, time-limited). Truthful information must be provided upon registration; an account is not transferable. Login credentials must be kept confidential; you are responsible for actions taken under your account, unless you lost access to third parties through no fault of your own.
A minimum age applies in accordance with statutory requirements for legal capacity to consent; minors require the consent of their legal guardian, in particular for purchasing paid features.
In particular, the following is prohibited when using Way of Citizen:
Violations may result in a warning or a temporary or permanent account suspension, depending on severity. The "Report player" feature and the ticket system are available for reporting violations.
When signing in via "Sign in with Google", Google transmits to us the email address and display name stored with your Google account, in order to create or match your Way of Citizen account. Details on data processing can be found in the Privacy Policy. Google's own terms of use additionally apply to the use of the Google service itself.
Way of Citizen offers optional paid premium features:
All prices are final prices; no VAT is shown, in accordance with Sec. 19 German VAT Act (UStG, small business regulation). Payment processing is handled by the payment provider Stripe, see the Privacy Policy for details.
Consumers generally have a statutory right of withdrawal of 14 days. As premium features are digital content not supplied on a physical medium, the right of withdrawal expires early once performance has begun, after you have expressly agreed that performance may begin before the withdrawal period ends, and you have confirmed your awareness that you lose your right of withdrawal as a result of this early performance.
Way of Citizen is under active development; software bugs may occur. Bugs can be reported via the ticket system or by email. There is no entitlement to error-free operation, uninterrupted availability, or the preservation of specific save-game data, without prejudice to mandatory statutory liability rules.
The provider is liable without limitation for intent and gross negligence, as well as under the Product Liability Act. For slight negligence, the provider is only liable for the breach of a material contractual obligation (cardinal obligation), limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slightly negligent breaches of duty is excluded. Liability for damages resulting from injury to life, body, or health remains unaffected.
You may have your account deleted at any time by contacting us via email. The provider may suspend or delete accounts for violations of item 4; in this case, any running premium subscription must be cancelled separately via Stripe or account management.
The provider reserves the right to amend these Terms of Use as needed, for example for new features or legal changes. Registered users will be informed of material changes to the extent reasonably possible (e.g. by email or an in-game notice).
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of these Terms of Use be invalid, the validity of the remaining provisions remains unaffected.
